Welcome to Fold. By downloading, installing, or using this application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. ACCEPTANCE OF TERMS

By accessing or using Fold, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. DESCRIPTION OF SERVICE

Fold is a personal tracking and self-improvement application designed to help users monitor their betting activity and/or track gambling sobriety. The App provides two modes of operation:

  • Sobriety Mode: Track days without gambling and estimate money saved.
  • Tracker Mode: Log and analyze betting history, fantasy sports entries, and financial performance.

Fold is a personal utility tool only. It does not facilitate, promote, or enable real-money gambling of any kind.

3. NOT PROFESSIONAL ADVICE

The information and features provided by Fold are for personal tracking and informational purposes only. The App does NOT provide:

  • Professional financial, investment, or tax advice
  • Medical, psychological, or addiction counseling
  • Legal guidance of any kind

4. USER RESPONSIBILITIES

You are solely responsible for:

  • The accuracy of all data you enter into the App, including bet amounts, outcomes, and financial figures.
  • Maintaining the security of your device and any data stored within the App.
  • Complying with all applicable local, state, and federal laws regarding gambling in your jurisdiction.
  • Any decisions you make based on information displayed in the App.

Fold does not verify the accuracy of user-entered data and is not responsible for any discrepancies between App data and your actual financial records.

5. INTELLECTUAL PROPERTY

All content, design, graphics, code, and other materials in the App are the intellectual property of Fold and its developers. You may not copy, modify, distribute, sell, or lease any part of the App or its content without prior written consent.

6. DATA AND STORAGE

All user data (bets, statistics, settings, and personal information) is stored locally on your device. Fold does not operate cloud servers for user data storage. If you uninstall the App or clear its data, your information will be permanently lost unless you have exported it using the App's built-in export features. You are responsible for backing up your own data.

7. THIRD-PARTY SERVICES

The App may access third-party data sources (such as lottery jackpot information) for informational display purposes. Fold does not guarantee the accuracy, availability, or timeliness of third-party data. These services are provided "as is" and may be discontinued at any time.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLD AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR:

  • Any financial losses incurred from gambling activities.
  • Inaccurate calculations or data displayed within the App.
  • Loss of data due to device failure, App updates, or uninstallation.
  • Any indirect, incidental, special, consequential, or punitive damages.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

9. MODIFICATIONS TO TERMS

We reserve the right to update or modify these Terms at any time. Changes will be reflected within the App. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

10. TERMINATION

You may stop using the App at any time by uninstalling it from your device. We reserve the right to discontinue the App or any features within it at any time without prior notice.

11. AI ANALYST

The AI Analyst feature (powered by Fold AI) provides automated data analysis based on your betting history. By using this feature, you acknowledge that:

  • AI outputs may be inaccurate, incomplete, or outdated.
  • The AI is not a financial advisor or professional tipster.
  • All AI processing happens locally on your device to ensure privacy.
  • You are solely responsible for any wagering decisions made after consulting the AI.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.
